These Terms of Use (“Terms”) apply to your use of the Adventure Companion mobile application (“Adventure Companion”, “the App”), provided by Get Out and Adventuring.
By downloading, accessing or using Adventure Companion, you acknowledge that you have read and understood these Terms and agree to use the App in accordance with them.
If you do not agree with these Terms, you should not use Adventure Companion.
Adventure Companion is designed as a trip-planning, organisation and informational tool for travel and outdoor adventures.

Features may be changed, added or removed as Adventure Companion develops.
Information provided through Adventure Companion is for general planning and informational purposes only.
Adventure Companion does not provide professional travel, navigation, safety, emergency, medical, legal or other professional advice.
You are responsible for obtaining appropriate professional or official advice where necessary.
Adventure Companion may provide access to maps, locations, search results, distances, directions and other geographic information.
This information may be inaccurate, incomplete, unavailable or out of date.
You should independently verify information that may affect your safety or travel plans, including:
Do not rely solely on Adventure Companion when making navigation or safety decisions.
Travel, camping, boating, fishing, four-wheel driving, hiking and other outdoor activities can involve significant risks.
Conditions may change rapidly and may be affected by weather, terrain, tides, wildlife, fire, flooding, equipment failure, vehicle capability, communications coverage and other factors.
You are responsible for assessing the suitability and safety of any activity you undertake.

Adventure Companion is not an emergency or rescue service.
The App is not a substitute for:
Do not rely on Adventure Companion as your sole means of navigation, communication or emergency assistance.
If you are in an emergency, use an appropriate method to contact the relevant emergency services.
You remain responsible for decisions you make before, during and after an adventure.
The existence of a location, destination, route, business, campsite, track, road or other place within Adventure Companion does not mean that the location is safe, accessible, legal or appropriate for you to visit.
You are responsible for checking applicable laws, regulations, restrictions, closures, permits and local requirements.
Adventure Companion may use or provide access to services supplied by third parties, including Apple services such as:
Third-party services are outside the direct control of Get Out and Adventuring.
Their availability, accuracy and operation may change without notice and may be subject to separate terms and privacy policies.
Get Out and Adventuring does not guarantee the accuracy, completeness or availability of information supplied by third-party services.
Adventure Companion may allow you to create or store information including:
You are responsible for content you add to the App.
You should only add photographs or other material that you have the right to use.
You retain responsibility for your own content.
The current version of Adventure Companion primarily stores user-created trip information locally on the user's device.
Deleting the App, losing or damaging your device, replacing your device, software failures or other circumstances may result in loss of locally stored information.
You are responsible for maintaining appropriate backups of information that is important to you.
Get Out and Adventuring does not guarantee that locally stored information can be recovered.
You must not intentionally use Adventure Companion:
Adventure Companion, including its original software, design, branding, graphics and other original content, is owned by or licensed to Get Out and Adventuring, except for material belonging to third parties.
Adventure Companion and Get Out and Adventuring branding may not be copied or used in a manner that falsely suggests endorsement, association or ownership without permission.
Third-party trademarks, services and content remain the property of their respective owners.
We may update, modify, suspend or discontinue features of Adventure Companion from time to time.
We do not guarantee that every feature will always be available or operate without interruption.
Updates to iOS, Apple services, third-party services or other technology may affect the availability or operation of Adventure Companion.
We aim to provide a useful and reliable application, but we do not guarantee that information available through Adventure Companion will always be accurate, complete, current or error-free.
Where information is important to your safety, travel, property or finances, you should verify it using appropriate authoritative sources.
To the maximum extent permitted by applicable law, Get Out and Adventuring is not liable for loss, damage, injury, expense or other consequences arising from or relating to:
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy that cannot lawfully be excluded, restricted or modified under applicable law, including applicable Australian consumer protection laws.
Nothing in these Terms is intended to exclude, restrict or modify rights or remedies that cannot legally be excluded under the Australian Consumer Law or other applicable Australian legislation.
Where liability may lawfully be limited, any limitation applies only to the extent permitted by law.

Adventure Companion contains additional Safety & Disclaimer information within the App.
You should read that information before relying on Adventure Companion for trip planning or outdoor activities.
The Safety & Disclaimer forms an important part of the information provided about the intended use and limitations of Adventure Companion.
Adventure Companion may offer optional paid or premium features in the future.
Where applicable, purchases made through Apple's platforms will be subject to Apple's applicable purchasing, subscription and refund terms as well as any additional terms presented for the relevant Adventure Companion service.
The availability of future paid features is not guaranteed.
These Terms may be updated from time to time to reflect changes to Adventure Companion, applicable law, Apple requirements or our business practices.
The Last Updated date at the top of these Terms will identify the most recent revision.
Where appropriate, significant changes may also be communicated through the App.
Continued use of Adventure Companion following an update may be subject to the updated Terms.
These Terms are governed by the laws applicable in Queensland, Australia, subject to any rights you have under laws that cannot legally be excluded or altered by agreement.
